Full payment is required when an order is placed. No work will proceed until payment is received and cleared. As a Kulture Fitz customer you are purchasing our custom graphic design services. We provide this product to you via email in the form of a proof. Once the proof has been approved, your item(s) will be created based on that layout that you approved and shipped to the address that you designated. You will have an opportunity to request changes as necessary before any custom work has started.
Sending in Garments
Kulture Fitz allows customers to send in their own personal garments for embroidery or screen printing to be added. In this situation, all Kulture Fitz Terms and Conditions as well as the following special conditions apply:
1. The customer is responsible for shipping the garment to Kulture Fitz and paying for the completed item to be shipped back with insurance,
2. Kulture Fitz maintains the right to refuse any garment if the condition of the garment is deemed unsuitable for the desired imprint,
3. If the customer’s garment is damaged during the production process, we will replicate the original garment to the best of our ability. We make no guarantee that the replacement will be identical to the original garment, only that it will be as similar to the original as possible,
4. Under no circumstances will Kulture Fitz pay monetary damages if the customer’s garment is lost in transit to Kulture Fitz or damaged during the production process.
Proofs for Custom Orders
Kulture Fitz provides a full color proof for each order as well as for any change(s) made to an order. As the customer, you are 100% responsible for the accuracy of your layout. Please review all proofs carefully before approving. Double check garment size, spelling, and color because your order will be created based on the final proof that you approve. All previous requests are null and void once we have sent you a proof.
Change requests are handled in the order that they are received. We will make the changes and email you back a revised proof for your approval. Once we receive your final approval, we will begin the production process and no further changes can be made. Your order will be created based solely on the proof that you APPROVED.
Changing Files Once the Production Process Has Begun
Once we have received final approval of the proof, no changes are allowed to the artwork, design, clothing size, job characteristics, or turnaround time. Change requests after an order has been APPROVED will incur a minimum charge of $50. No exceptions. It does not matter how minor the change may seem or how soon after the order has been APPROVED. In some circumstances, a change request may be subject to the full price of a new garment.
If you want to change a non-custom order once we have started making it, there will be a 30% restocking fee because we have to restock the item that we started making for you and start the process all over again making your new item.
We start counting the turnaround time when we receive proof approval. Upon receiving an order, a proof is usually submitted to the customer via email within 2 business days (if your design is very complicated, developing the proof may take longer). This proof will be a nearly exact replica of your garment, and you will be given the opportunity to request changes before you approve. No changes are permitted after proof APPROVAL.
Normal estimated 7, 10, or 15 business day production time: Once the proof has been approved, our estimated production time is approximately7, 10, or 15 business days depending on what item you ordered. Estimated production times are listed here. Production time is an estimate, not a guarantee. Your order could be completed a few days sooner or a few days later than the estimated date. Shipping time is not included in the estimated production time. Upon request, we can work to meet a specific timeline for certain projects; however, again these times are not guaranteed unless you upgrade to Rush Production. Business days are Monday through Friday. Holidays, Saturdays and Sundays do not count when calculating turnaround time. Group orders may take longer than the estimated turnaround time. Items ordered during peak season (between Sept-May) may take longer than the estimated turnaround time. Kulture Fitz assumes no responsibility for delays caused by delivery carriers or any damages resulting from the failure to receive an order on time. Our estimated delivery date is not guaranteed. Your order may arrive late due to unforeseen delays in delivery service, the breakdown of equipment, illness, inclement weather, etc. Kulture Fitz also assumes no responsibility for proof delays due to email server problems.
2-Week Rush Production: Your order will be shipped within two weeks, not counting holidays, from the date of proof approval. If your order arrives later than promised, we will refund the Rush Production fees.

All turnaround time guarantees exclude delays as a result of natural disasters and/or material shortages.
We will refund Rush Production fees if:
- the order did not arrive on time, or
- the garment is physically unwearable due to a manufacturing defect.
Aside from that, we do not refund Rush Production fees.
Artwork and Icons
Any requested design that is not
already in our design library may be subject to a separate one-time digitizing
fee. The amount of this digitizing fee varies depending on the complexity. The
customer will be notified in advance if additional fees are required to create
a certain design. The digitizing fee is a one-time fee, and the digitized image
may be reused on future orders at no additional charge. We reserve the right to
refuse any design for any reason.
Any design submitted to Kulture Fitz or used on any article of clothing created by Kulture Fitz may be reused, modified, and/or resold by Kulture Fitz. Kulture Fitz does not furnish a digitized embroidery file to the customer for any purpose.
The customer consents to this release: I grant to Kulture Fitz the absolute and irrevocable right and unrestricted permission concerning any photographs taken of me or in which I may be included with others, without compensation, to use, reuse, publish, and republish the photographs in whole or in part, individually or in connection with other material, in any and all media now or hereafter known, including the internet, and for any purpose whatsoever, specifically including illustration, promotion, art, editorial, advertising, and trade, without restriction as to alteration; and to use my name in connection with any use if the company so chooses. I release and discharge Kulture Fitz and its affiliates from any and all claims and demands that may arise out of or in connection with the use of the photographs, including without limitation any and all claims for libel or violation of any right of publicity or privacy. This authorization and release shall also inure to the benefit of the heirs, legal representatives, licensees, and assigns of Kulture Fitz.
The customer will indemnify and hold harmless Kulture Fitz and its affiliates from any and all losses, cost expense, and damages on any and all manner of claims, demands, actions, and proceeding that may be instituted against Kulture Fitz on the grounds alleging that said designs or artwork violates any copyright or any proprietary right of any person or entity.
All images displayed on this site are requested by customers for their personal use. Any similarity between the images contained herein and any person’s likeness or any company trademark or logo is purely coincidental. Kulture Fitz assumes no liability or responsibility to determine whether a customer has secured consent from any party for the use of their image, logo or trademark. The customer absorbs sole responsibility for securing usage rights for all copyrighted artwork.
The customer represents that all
materials utilized by the seller in the distribution of the merchandise
described in this web site (specifically including, but not limited to, the
Greek Organization’s letters, crests, coat of arms, logos, school or university
references, insignias, or other designs) will not cause or result in the
violation of any law, judicial decision, rule, regulation, ordinance,
licensing, franchise or similar agreements, informal or formal, oral or
written, relating to trademarks, service marks, copyrights, patents, etc.
The customer further represents that he/she has the free, full, and unqualified right and authority to purchase and grants the seller the rights to sell all of the materials described on this web site. The customer acknowledges that the seller shall assume no liability for compliance or non-compliance with said laws, rules, agreements, etc. The seller hereby disclaims all such liability, if any.
The customer agrees to indemnify and hold seller harmless from and against any loss, costs, fees, fines, licensing fees, penalties, damage, and/or assessment, or other expenses (including any attorney fees which may be incurred by seller) which may arise as a result of the sellers application, fabrication, and/or production of materials described on this web site.
The products contained on the web site are for demonstration purposes only and do not indicate or imply that any such designs, logos, or names may be reproduced without proper authorization or permission. Certain national Fraternities & Sororities require official licensed vendors to pay royalty fees on purchases. Some customized products may not be available (due to licensing agreements and/or other availability issues) for all organizations.
The Kulture Fitz Brand
We reserve the right to brand garments with the KultureFitz logo. We intentionally make the KultureFitz logo small and inconspicuous so that it does not interfere with or draw attention away from the garment’s design. The KultureFitz brand signifies your apparel authenticity and quality. Our customers are proud to have the brand on their apparel to assure them that they are not wearing a cheap “knock-off” or imitation. The brand is usually semi-hidden at the bottom of the garment.
Kulture Fitz reserves the right to cancel or refuse any order at any time for any reason.
